1. Acceptance of Terms
By subscribing to or using our internet services, you agree to comply with and be bound by these Terms and Conditions. If you do not agree, you must discontinue use of our services immediately.
2. Service Description
TonyComm Group Ltd provides broadband internet access and related services to residential and commercial customers. The specific service plan, bandwidth, and pricing are outlined in your service agreement or welcome letter.
3. Eligibility and Registration
Customers must be 18 years or older to subscribe. Accurate information must be provided during registration and must be kept up-to-date.
4. Billing and Payments
- Billing Cycle: Monthly in advance.
- Payment Methods: M-Pesa, bank transfer, and other approved channels.
- Late Payments: A grace period of 1 day is allowed; services may be suspended thereafter.
- Reconnection Fee: KES 0 for reconnection after disconnection due to non-payment.
5. Acceptable Use Policy
You agree not to use our services:
- For unlawful purposes
- To distribute malware, spam, or harmful content
- To infringe on copyrights or intellectual property
- To abuse or attempt to hack the network
We reserve the right to monitor usage and take appropriate action for any violations.
6. Data Privacy
We value your privacy. Personal data collected during registration or use is handled according to our Privacy Policy. We do not sell or share your data with third parties without consent.
7. Fair Usage Policy
To ensure network quality, all plans are subject to a Fair Usage Policy. If excessive usage is detected, we may reduce speed temporarily or request plan upgrade.
8. Service Availability
While we strive for 99.9% uptime, service interruptions may occur due to maintenance, technical faults, or issues beyond our control. We are not liable for losses arising from such downtime.
9. Termination
Either party may terminate the agreement with a 30-day notice. TonyComm reserves the right to suspend or terminate services immediately in cases of breach of terms, fraud, or illegal activity.
10. Liability Limitation
TonyComm shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of data, revenue, or business due to service disruptions
- Issues arising from third-party devices or apps
11. Amendments
These terms may be updated periodically. Customers will be notified via email or SMS. Continued use after changes constitutes acceptance of the new terms.
12. Governing Law
These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the Kenyan courts.
